Anywhere Real Estate Reaches Settlement in Antitrust Lawsuit

Anywhere Real Estate Inc. (NYSE: HOUS), a prominent player in the global residential real estate market, has obtained preliminary court approval for its comprehensive settlement agreement aimed at resolving all claims made against the company in the Burnett, Moehrl, and Nosalek antitrust class action litigation. This significant settlement, valued at $83.5 million, includes both monetary and injunctive relief.

The settlement, which has been in the works since October 2023, certifies the Settlement Class and permits potential class members to be notified. It is anticipated that the final approval hearing will be held in mid-2024.

As part of the settlement terms, Anywhere will provide monetary relief in alignment with its financial planning. It is important to note that this settlement does not constitute an admission of liability on the part of Anywhere.

Upon receiving final court approval, Anywhere, its subsidiaries, brands, affiliated agents, and franchisees will be released from any ongoing or future litigation related to antitrust claims. This includes the recent jury verdict in the Burnett class action suit.

Ryan Schneider, the Chief Executive Officer and President of Anywhere Real Estate, expressed their satisfaction with the court’s preliminary approval. Schneider emphasized the company’s dedication to resolving the claims and eliminating any future uncertainty and legal expenses.

The settlement also introduces practice changes within Anywhere Advisors, the company’s owned brokerage operations, for a period of five years following final court approval. These practice changes will also be recommended and encouraged across the independently owned and operated franchise network associated with various brands owned by Anywhere.
